NEW ZEALAND VISA CATEGORIES
Temporary Visas
We can apply for Temporary Visas for you under a number of categories - Visitor Visa, Student Visa, Temporary Work Visas, Temporary Visas for people needing to enter New Zealand for business purposes, Temporary Visas for family members and a Temporary Retirement Visa for people over 65 who meet the requirements. Temporary Visas are applied for per person, whereas a Residence Visa application can include immediate family members in some circumstances. When we are handling your application we will make sure each family member has the right Temporary Visa to meet their needs.
Permanent Residence Visas
Once you have been granted residence in New Zealand you will be able to remain permanently in New Zealand if you don't leave the country. However, there will be travel conditions on your first resident visa allowing you to enter and leave New Zealand for the first two years. If you have maintained a clean criminal record and demonstrated a long term commitment to New Zealand you can apply for indefinite travel conditions, which will allow you to enter and leave New Zealand at will for the rest of your life. This is called a Permanent Resident Visa.
It is often possible to live and/or work in New Zealand on a Temporary Visa while your Residence application is processing.
Family Residence Visas
Family relationship-based visa categories include temporary and permanent visa options, and we will help you get the visa or visas that best suit your needs. (Some visas must be applied for from outside New Zealand, other visas can be applied for if you are already in New Zealand visiting, but have long processing times so the timing needs to be carefully managed and you may require a series of temporary visas while your residence application is processing.)
You may be able to gain permanent residence in New Zealand by applying for a Parent Visa, Sibling Visa (for brothers and sisters of New Zealand citizens or permanent residents), or as an Adult Child Visa, and may be able to include your spouse/partner and dependent children up to the age of 24 in your application. There are no New Zealand visa applications which allow you to include your parents or dependent family members other than children in your own application - you must hold residence and meet qualifying conditions in order to be able to sponsor your other family members who will apply separately. Different restrictions apply to each type of application, and also to your New Zealand-resident sponsor. For example, there may be an age limit, your application will be affected by where your other family members live, your sponsor may be required to have held residence for at least 3 years before they can sponsor you and be earning a minimum income amount, you may be required to have a job offer with minimum income requirements as part of your Family Visa application etc. There are no English language requirements for most Family Visa applications.
Parents who have the ability to invest NZD$1million in New Zealand for 4 years and who meet other requirements will get fast-tracked residence under the Parent Retirement Category.
We also assist with Partnership Temporary Work Visa and Partnership Residence Visa applications for the spouse or partner of New Zealand citizens or permanent residents, and will ensure that your Dependant Child or Children have the appropriate visas to be in New Zealand with you.
Skilled Migrant Residence Visas
There are two key elements that make up a successful application for Skilled Migrant Residence. You must have skills and experience that qualify you to immigrate under Immigration New Zealand's points system, and have or obtain a job offer that meets immigration requirements. Note that there are advantages if you meet the requirements of the New Zealand Long Term Skill Shortage List, but you can still apply if you (and your job offer) are skilled but not on the shortage list as long as you meet the minimum points requirement. Although it was previously possible to make a Skilled Migrant application without a job offer if you met Long Term Skill Shortage List requirements and be granted residence, Immigration New Zealand has now imposed a requirement that all successful applicants without a job offer will be granted a special 9-month Work to Residence Visa to find a skilled offer of employment, after which full Skilled Migrant Residence will be granted. Your spouse/partner and dependent children up to age 24 may be able to be included in your application, and you must meet English language, health and character requirements.
We offer a unique service that can support your job search, making it more likely you will be able to secure an offer of skilled employment, and can get you a Temporary Work Visa to allow you to start work while your Skilled Migrant application is processing. NB The ability to start work quickly is crucial to most employers - our aim is for clients to be able to start work within 4-6 weeks of receiving a job offer if they have been working with us to prepare everything in advance. Residence will generally be granted within 3-12 months, and you may have restrictions placed on you requiring to work in your skilled job for a further 3 months.
Business Visas
People with a history of business ownership or who have worked at a senior management level may be able to migrate by buying or starting up a business in New Zealand. The Long Term Business Visa (LTBV) is a special category of work visa allowing self-employment in New Zealand. It is dealt with by a special business branch of Immigration New Zealand. A 25% or more share of a business is sufficient to be able to apply for an LTBV (provided you intend to actually work in the business full-time), however most of our Long Term Business Visa clients buy or start up a business that they have full ownership of. You must show you have enough capital to buy/start up the business, and additional funds to cover your living costs in the first 3 years, plus meet English language and other requirements. You may include your spouse/partner and dependent children in the Long Term Business Visa application. You must work full time in the business after the visa is granted, and there will be limits on how much time you can spend outside New Zealand without affecting your subsquent residence application. After operating the business for 2-3 years you can apply for residence under the Entrepreneur Residence Category if you meet the requirements. This application may include your spouse/partner and dependent children up to age 18, and there is an accelerated Residence application process called Entrepreneur Plus for applicants who have invested at least NZ$500,000 and created at least 3 new full time jobs for New Zealand citizens or permanent residents.
Investor Visas
With one of the highest business start-up rates in the world, New Zealand welcomes entrepreneurs and people interested in investing in New Zealand business opportunities. The type of Investor Visa that best suits you will depend on the amount of your investment and other factors.
Investor Visas (Investor 2 Category) have a lower investment requirement of only NZD$1.5 million invested in New Zealand for 4 years, but must have a further NZD$1million available for settlement funds. There is an upper age limit of 65, you must pass an English language test and meet specific requirements as to the amount and type of previous business experience you have. You must also be able to prove the source and ownership of all your investment funds. You will be able to include your spouse/partner and dependent children up to age 24 in your visa application. With this visa you will be required to spend 146 days in New Zealand in each of the last three years of the four-year investment period.
Investor Plus Visas (Investor 1 Category) are granted to Investors who can invest NZD$10million or more for 3 years. There are no age limits or English language requirements, and you only need to spend 44 days in New Zealand for each of the last 2 years of the 3-year investment period, therefore this visa will be very attractive to Investors wanting to maintain their other business interests overseas. There are restrictions on the types of investment you can make and you must meet health and character requirements. You must be able to prove the source and ownership of all your investment funds and must be able to transfer them to New Zealand through the banking system. You will be able to include your spouse/partner and dependent children up to age 24 in your visa application.
Investors aged 66 or above who want to retire to New Zealand can apply under the Temporary Retirement Visa category. This is a lower cost visa as you need only show investment funds and/or assets equivalent to at least NZD$0.75million and undertake to invest them in New Zealand for a period of two years. You must also have NZD$0.5million for maintenance funds, and be able to show an annual income of NZD$60,000 at the time of your application. You must meet hold comprehensive travel or health insurance for the duration of your visa. The downside of this visa is that it is only granted for 2 years, and you must therefore re-apply every 2 years if you want to keep living in New Zealand. You must meet the investment requirements and still be able to obtain comprehensive insurance every time you re-apply, and this can become more difficult as you get older. A Temporary Retirement Visa will never result in residence status.
